Terms of Service

These Terms of Service ("Terms") govern your access to and use of FORGA360's website, mobile applications, APIs, and all related services (collectively, the "Platform") operated by FORGA360 ("we," "us," or "our").

By creating an account, uploading content, or otherwise accessing any part of the Platform, you confirm that:

• You are at least 18 years of age or have parental/guardian consent.
• You have the legal capacity to enter into a binding agreement.
• You agree to comply with all applicable local, national, and international laws.
• You have read, understood, and accept these Terms in full.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

FORGA360 is a 360° virtual tour platform that enables:

• Tour Owners to upload, host, manage, and share immersive virtual tours of their properties, venues, or businesses.
• Visitors to browse, view, favorite, and share publicly available 360° virtual tours.
• Live Guided Tours — real-time video-call sessions between Tour Owners and prospective clients.
• Analytics — performance tracking tools for Tour Owners.
• Embedding — iFrame-based tour embedding on third-party websites.

We may modify, suspend, or discontinue any feature or aspect of the Platform at any time, with or without notice, and we will not be liable to you or any third party for such actions.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with any third party.
• Notify us immediately at info@forga360.com of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

Tour Owner accounts are subject to admin approval before being granted upload privileges. We reserve the right to approve or reject applications at our sole discretion.

If you register as a Tour Owner, additional responsibilities apply:

• You represent and warrant that you have the legal right to publish all content you upload, including 360° imagery and associated materials.
• You must ensure that any individuals captured in your tours have provided appropriate consent, or that their faces/identifying features are adequately obscured.
• You are solely responsible for the accuracy of property descriptions, pricing, and attributes listed in your tours.
• Your first year of hosting is included in your service package. Annual renewal fees apply thereafter as per your selected plan.
• Free reshoot entitlements (up to 3 scenes, within 3 months of delivery) are subject to scheduling availability and geographic coverage.

We reserve the right to remove any tour that violates these Terms or that we reasonably believe could expose us or users to legal liability.

You agree not to upload, share, or transmit any content that:

• Is false, misleading, defamatory, or fraudulent.
• Infringes any third-party intellectual property, privacy, or personality rights.
• Contains sexually explicit, obscene, or pornographic material.
• Promotes violence, discrimination, or illegal activity.
• Contains malware, viruses, or any other harmful code.
• Violates any applicable Egyptian or international law.

You also agree not to:

• Use automated tools to scrape, crawl, or extract data from the Platform without prior written consent.
• Attempt to reverse-engineer, decompile, or circumvent any security features.
• Create multiple accounts to evade a ban or restriction.
• Misrepresent your identity or affiliation with any person or entity.

Our IP: The FORGA360 name, logo, platform design, software, and all related technology are owned by FORGA360 and protected by applicable intellectual property laws. You may not use our branding without prior written permission.

Your Content: You retain ownership of the content you upload. By uploading content to the Platform, you grant FORGA360 a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute your content solely for the purpose of operating the Platform and providing the services you have requested.

Embed Licence: When you share an embed code, you grant third-party website owners a limited, non-transferable licence to embed and display the specific tour via iFrame, subject to these Terms.

This licence terminates when you delete the relevant content or close your account.

Pricing for services is as set out on our Pricing page and any order confirmation you receive. All prices are in Egyptian Pounds (EGP) unless stated otherwise.

• A 50% deposit is required to confirm your booking and schedule a shoot.
• The remaining balance is due upon delivery of the completed virtual tour.
• Annual hosting renewals are invoiced prior to the renewal date and must be paid within 14 days to avoid service interruption.
• Promotional discounts (such as our limited-time 40% offer) are applied at checkout and cannot be combined with other offers unless explicitly stated.

Payments are accepted via bank transfer, cash, and Vodafone Cash. Instalment arrangements may be available for larger projects at our discretion.

All sales are subject to our Refund Policy.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of data as described in that policy.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, FORGA360 disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties regarding the accuracy, reliability, or completeness of any content on the Platform.
• Warranties that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

FORGA360 does not endorse, verify, or guarantee any content uploaded by Tour Owners. Virtual tour imagery is provided for informational purposes only and may not reflect current conditions.

To the maximum extent permitted by applicable law, FORGA360 and its officers, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data.
• Loss of goodwill or business opportunities.
• Costs of substitute services.
• Damages arising from reliance on any content displayed on the Platform.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice, including if we believe you have violated these Terms.

You may close your account at any time by contacting us at info@forga360.com. Upon termination:

• Your right to use the Platform immediately ceases.
• Your published tours will be taken offline within 7 business days.
• Any outstanding annual hosting fees remain payable.
• Refunds, if applicable, are subject to our Refund Policy.

Sections covering intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

These Terms are governed by the laws of the Arab Republic of Egypt. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cairo, Egypt.
